DIRECT PAY SUBSCRIPTION TERMS
PAYMENT AUTHORIZATION
1. THE PLAYER AUTHORIZES OLG TO PROCESS PAYMENT ON THE PLAYER’S SELECTED PAYMENT CARD IN RESPECT OF THEIR SELECTED DIRECT PAY SUBSCRIPTION (FOR THE PRICE AND SUBSCRIPTION CONFIGURATION DISPLAYED IN THEIR CHECKOUT CART) IN ACCORDANCE WITH THE PAYMENT SCHEDULE (“PAYMENT SCHEDULE”) SET OUT BELOW AND IN THE TABLE BELOW:
(a) for eligible Draw-Based Games Played Online in which two Evening Draws occur per week (“Bi-Weekly Lottery Games”), attempts to purchase a ticket (other than the initial purchase of the ticket for the first draw in respect of a Direct Pay Subscription) will be made between approximately 8 a.m. and 9 a.m. on the day following a draw scheduled for approximately 10:30 p.m. (“Evening Draw”) until the day of the applicable draw, unless a ticket is successfully purchased during such time period;
the following Bi-Weekly Lottery Games are eligible for Direct Pay Subscriptions;
- i. “Lotto Max,” with Evening Draws every Tuesday and Friday;
- ii. “Lotto 6/49,” with Evening Draws every Wednesday and Saturday;
- iii. “Ontario 49,” with Evening Draws every Wednesday and Saturday; and
- iv. “Daily Grand,” with Evening Draws every Monday and Thursday; and
(b) for eligible Draw-Based Games Played Online in which one Evening Draw occurs per week (“Weekly Lottery Games”), attempts to purchase a ticket (other than the initial purchase of the ticket for the first draw in respect of Direct Pay Subscription) will be made between approximately 8 a.m. and 9 a.m. on the day following draws scheduled for approximately 10:30 p.m. (“Evening Draw”) until the day of the applicable draws, unless a ticket is successfully purchased during such time period;
The following Weekly Lottery Games are eligible for Direct Pay Subscriptions:
- i. “Lottario,” with Evening Draws every Saturday.
(c) for Daily Lottery Games (as defined in the iLottery Rules) “Pick-2”, “Pick-3”, “Pick-4” and “Daily Keno”,
- i. attempts to purchase a ticket (other than the initial purchase of the ticket for the first draw in respect of a Direct Pay Subscription) for a draw scheduled for approximately 2:30 p.m. (“Midday Draw”) will be made at approximately 8 a.m., 10 a.m. and 12 p.m. on the day of the applicable draw unless and until a ticket is successfully purchased during one of these time periods; and
- ii. attempts to purchase a ticket (other than the initial purchase of the ticket for the first draw in respect of a Direct Pay Subscription) for an Evening Draw will be made at approximately 4 p.m., 6 p.m. and 8 p.m. on the day of the applicable draw unless and until a ticket is successfully purchased during one of these time periods.

INTRODUCTION
2. These Direct Pay Subscription Terms, as amended or replaced from time to time by OLG, contain the terms and conditions that govern subscriptions for tickets for a Draw-Based Lottery Game Played Online made through Direct Pay in accordance with Section 5 of the Player Agreement (a “Direct Pay Subscription”). The Player Agreement, the OLG Rules Respecting iGaming Lottery Games (“iLottery Rules”), the applicable Lottery Game Rules, and the applicable tickets (as defined in the iLottery Rules) are hereby incorporated into and form part of these Direct Pay Subscription Terms. Any conflict or inconsistency between these Direct Pay Subscription Terms and any of the foregoing documents shall be resolved in accordance with Section 3 of the Player Agreement. Any capitalized terms not otherwise defined herein shall have the meaning ascribed to them in the Player Agreement.
3. By checking the “accept” box, a Player is confirming that they understand and agree to be bound by these Direct Pay Subscription Terms. If a Player does not agree with any of the terms and conditions of these Direct Pay Subscription Terms, the Player: (i) is not permitted to obtain a Direct Pay Subscription; and (ii) if the Player already has a Direct Pay Subscription, they must terminate their Direct Pay Subscription immediately in accordance with the Player termination process set out in Section 18.
4. OLG reserves the right to revise these Direct Pay Subscription Terms from time to time in such manner as OLG, in its sole discretion, determines to be appropriate. Material changes to Direct Pay Subscription Terms including but not limited to changes to Lottery Game Rules or price will result in the publication of updated Direct Pay Subscription Terms. In order to continue with the Direct Pay Subscription for that Draw-Based Lottery Game Played Online, Direct Pay Subscription Players must accept the revised Direct Pay Subscription Terms, failing which their Direct Pay Subscription will be cancelled and no further tickets will be purchased on their behalf.
5. A Direct Pay Subscription is associated with the Player Account through which it is initiated and cannot be assigned or transferred to or shared with any other person by the Player for any purpose.
METHOD OF PAYMENT FOR DIRECT PAY SUBSCRIPTION
6. A Player must use one of the following payment methods in accordance with Section 6 of the Player Agreement to subscribe to a Direct Pay Subscription (each, a “Payment Card”):
(a) Visa, MasterCard, or American Express credit card issued in Canada by a Canadian bank or financial institution, which the Player is an authorized user, as defined by the Canadian bank or financial institution, to use the Visa, MasterCard, or American Express credit card for such purpose;
(b) a Visa Debit card issued in Canada by a Canadian bank or financial institution, which the Player is an authorized user, as defined by the Canadian bank or financial institution, to use the Visa Debit card for such purpose; or
(c) a Debit Mastercard issued in Canada by a Canadian bank or financial institution, which the Player is an authorized user, as defined by the Canadian bank or financial institution, to use the Debit Mastercard for such purpose.
For certainty, a Player is not permitted to use Unutilized Funds nor Bonus Funds, in each case from their Player Account, to pay for a Direct Pay Subscription.
7. A Player may request to change the funding method for their Draw-Based Games Played Online subscription: (i) from a Direct Pay Subscription to Unutilized Funds and/or Bonus Funds associated with their Player Account; or (ii) vice versa, at any time. The next scheduled ticket purchase after the request will be attempted on the newly selected payment method. A Player may update their payment method through the “Manage Payment” link in the “Subscription Details” page associated with their Player Account. Following any update, the Player authorizes OLG to process payment through the updated payment method in accordance with these Direct Pay Subscription Terms.
8. OLG or its payment processing service providers may store Visa, MasterCard, or American Express credit card, Visa Debit card or Debit MasterCard (as applicable) information on servers located outside of Ontario, but within Canada. In addition, OLG and its payment processing service providers may use and disclose aggregated transaction information for various analytical purposes relating to their respective businesses (but not relating to a specific or identifiable Player). By using a payment method listed in Section 6(a) to (c) for a Direct Pay Subscription, the Player expressly consents to OLG or its payment processing service providers, or both, storing such transaction information located on servers located outside of Ontario, but within Canada and using and disclosing aggregated transaction information for the purposes described in this paragraph.
9. Each time OLG attempts to process a payment through the Payment Card selected by the Player for a Direct Pay Subscription, the Player represents and warrants to OLG that the Player has all necessary rights and authority to use such Payment Card for such purposes, including in circumstances in which the Payment Card is jointly held with one or more other persons or is held by a person other than the Player.
INITIATING A DIRECT PAY SUBSCRIPTION
10. In order to initiate a Direct Pay Subscription, payment for the ticket for the first draw of the Direct Pay Subscription must successfully be processed at the time of initiating the Direct Pay Subscription.
11. The following conditions must be met at the time of the transaction for a ticket purchase to be processed as part of a Direct Pay Subscription:
(a) the Payment Card is valid, operational and authorized to process the transaction (“Funded”);
(b) the Player is within the Lottery Spend Limits (as contemplated in the Responsible Gambling and My PlayBreak Policy) selected by the Player, if applicable, and would not exceed such limits if the transaction was processed;
(c) the Player is not an individual registered for My PlayBreak (as contemplated in the Responsible Gambling and My PlayBreak Policy); and
(d) the ticket is recorded in the Central Computer System (as defined in the iLottery Rules).
12. A ticket associated with the Direct Pay Subscription will be deemed not to have been purchased if any one of following circumstances arises at the time of the transaction:
(a) the Payment Card is not Funded;
(b) the Player is not within the Lottery Spend Limits selected by the Player, if applicable, or would exceed such limits if the transaction was processed;
(c) the Player is an individual registered for My PlayBreak; or
(d) the ticket is not recorded in the Central Computer System (as defined in the iLottery Rules).
13. If a Chargeback occurs in respect of all or part of a transaction connected to a Direct Pay Subscription, the applicable ticket is void and OLG (or any of its third-party service providers) may take any or all of the actions contemplated in Section 6.4 of the Player Agreement.
TERMINATION AND SUSPENSION OF A DIRECT PAY SUBSCRIPTION
14. Unless suspended or terminated in accordance with these Direct Pay Subscription Terms, a Player’s Direct Pay Subscription will remain active (subject to system availability):
(a) in the case of the “consecutive draw” option, for the number of draws designated by the Player (for example, if a Player designates ten draws for their Direct Pay Subscription and a ticket for the eighth draw in the sequence fails to be purchased because the Payment Card is not Funded, at that point the Player will be entitled to participate in three more draws as part of the Direct Pay Subscription in accordance with these Direct Pay Subscription Terms);
(b) in the case of the “never miss a draw” option, indefinitely.
15. If OLG suspends a Player’s Player Account in accordance with the Player Agreement, all Future Game Transactions (as defined in the Player Agreement) associated with a Direct Pay Subscription will be cancelled for the duration of the suspension.
16. OLG will terminate a Player’s Direct Pay Subscription immediately (with or without providing written notice to the Player) upon any one of the following circumstances arising:
(a) the Player becomes an individual registered for My PlayBreak for a term equal to or greater than three (3) months;
(b) a ticket fails to be purchased, due to the Payment Card not being Funded, for four consecutive draws in respect of a single Direct Pay Subscription;
(c) the Player breaches any term of these Direct Pay Subscription Terms; or
(d) OLG deactivates a Player Account in accordance with the Player Agreement.
17. Subject to Section 16, OLG may terminate a Player’s Direct Pay Subscription immediately at any time by providing written notice to the Player.
18. A Player may terminate their Direct Pay Subscription at any time through the “Subscription Details” page associated with their Player Account or by contacting Player Support through the “Contact Us” page or by calling 1-800-387-0098.
19. Upon termination of a Direct Pay Subscription:
(a) OLG shall not have any further obligation to process any ticket purchases in respect of the Direct Pay Subscription; and
(b) the Player shall not be entitled to any future ticket that would have been purchased as part of the Direct Pay Subscription, nor any Prize (as defined in the Player Agreement) or other benefit associated with any such ticket, had the Direct Pay Subscription not been terminated.
