Ontario Lottery and Gaming Corporation 

July 18, 2024 – August 11, 2024

PROMOTION ELIGIBILITY: 

1.   The Sponsored By You Activation (the “Promotion”) is sponsored by the Ontario Lottery and Gaming Corporation (“OLG”) and managed by Momentum (the “Promotion Administrator”). The Promotion is open to residents of Ontario, who (at the time of participation): (i) are eighteen (18) years of age or older; and (ii) are not self-excluded, as determined by OLG in its sole discretion and as reflected in the Alcohol and Gaming Commission of Ontario (“AGCO”) guidelines and interpretation statements (each an “Eligible Participant”). 

Volunteers, employees, officers, and directors of OLG, the AGCO, the Canadian Olympic Committee (“COC”), the Canadian Paralympic Committee (“CPC”), their respective direct and indirect subsidiaries, affiliates, owners, shareholders, officers, directors, agents, representatives and employees, or any of OLG’s advertising, promotion and Promotion management agencies are not eligible to participate in the Promotion.

2.    In the event that an Eligible Participant does not meet the eligibility requirements stated herein, OLG may, in its sole discretion, disqualify that Eligible Participant. OLG will have no obligation to award any Prize to such an Eligible Participant.

3.    The Promotion begins at 08:00 AM EDT on July 18, 2024, and ends at 11:00 PM EDT on August 11, 2024, but is only available at the specific Event Locations (See Rule 7) during the specific days and times set out in Rule 8 during this period (the “Promotion Period”).

4.    As part of this Promotion, at each Event Location (defined below), a limited number of scratch cards will be made available (each, a “Scratch Card”). Eligible Participants may receive a maximum of one (1) Scratch Card upon entry into the Event Location as set out in these Promotion Terms. The Eligible Participant is eligible to win the prize associated with the Tier (a “Prize”) revealed upon scratching the Eligible Participant’s Scratch Card. There are three prizing tiers associated with the Scratch Cards – Gold, Silver, and Bronze prizing (each, a “Tier”), as set out in more detail in Section 8 below. Gold Tier winners can choose between the available prizes available within their tier at the respective Event Location, while quantities last.

5.   VIP “Back Alley” at 19-21 Ossington Ave: Eligible Participants who attend the 19-21 Ossington Ave Event Location on July 26-27, 2024 will also be provided with a wristband (“Wristband”) permitting access to the VIP back alley to attend one (1) of three (3) scheduled artist performances per day, the details and times of which will be communicated at the 19-21 Ossington Ave Event Location (each, a “Performance”). The VIP back alley is limited to 200 patrons for each Performance, and as such access to the VIP back alley is first come, first served and subject to availability. Wristbands do not guarantee access to any Performance. The VIP back alley can only be accessed via the 19-21 Ossington Ave Event Location. Doors will open thirty (30) minutes prior to each Performance. The actual timing of each Performance is subject to change. The Eligible Participant must show their Wristband at the security check in order to gain access. OLG has the right, at its sole and absolute discretion, to remove or deny entry to any person for any reason OLG deems appropriate including but not limited to intoxication or unsafe or unruly acts. The Wristbands and the access they grant have no cash value. OLG expressly disclaims any and all liability in relation to an Eligible Participant’s participation in the VIP “Back Alley” promotion and/or attendance at any Performance. Eligible Participants hereby agree to release, indemnify and hold harmless the Released Parties (as defined herein) from and against any and all claims, losses, damages, liabilities and costs and expenses (including reasonable legal fees) which arise from or are in any way related to the Eligible Participant’s participation in the VIP “Back Alley” promotion and/or attendance at any Performance.

HOW TO ENTER (NO PURCHASE NECESSARY):

6.    NO PURCHASE NECESSARY. To enter, during the Promotion Period, Eligible Participants must attend one of the below activations “Event Location” (as described below), during one of the times as set out below and locate the OLG “Sponsored By You” activation area:

7.     In order to participate in the Promotion an Eligible Participant must collect a Scratch Card from the kiosk at one of the Event Locations listed in Section 6. After receiving the Scratch Card from an OLG Representative, Eligible Participant must scratch at the marked area to reveal the prizing Tier. The Eligible Participant must then collect the corresponding Prize at the prizing booth located at the Event Location. IMPORTANT NOTE: Eligible Participants can only receive and scratch one (1) Scratch Card per Event Location.   Scratch Cards are first come, first served and are available only while supplies last at each Event Location.

8.    Eligible Participants can only redeem a Scratch Card for a corresponding Prize from an OLG representative at the Event Location where they received the Scratch Card.  Any attempts to obtain the corresponding prize otherwise will render the Scratch Card null and void and the Eligible Participant will be considered disqualified from this Promotion.

9.    PRIZES

Further information on Live Nation prizing for Gold Tier 19-21 Ossington Ave and VELD Toronto events: 

19-21 Ossington Ave:

·    Two (2) Prizes with each including two (2) 3-day general admission tickets and

·    Three (3) Prizes with each including two (2) 3-day VIP tickets to Veld Festival as at Downsview Park in Toronto, ON scheduled to take place from August 2, 2024 to August 4, 2024 (“Festival”). Parking, travel and accommodations not included and are the sole responsibility of winner and guest. Tickets will be awarded by OLG once winners have been verified. Winner and guest must be at least eighteen (18) years of age and must abide by all venue and Veld Festival policies: https://veldmusicfestival.com/festival-guide/, to include but not limited to, showing a valid photo ID at venue for age verification and/or identification purposes if requested. Live Nation reserves the right to revoke full or partial prize from any winner or winner’s guest who it and/or Festival/venue personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any Festival/venue policy or law, and/or may bring Live Nation into disrepute. Winner understands that there are inherent risks involved in being in public spaces and that these risks may be present before, during and after the Festival. Resale of tickets is prohibited. By claiming tickets, you agree to Festival Tickets Terms of Use and to abide by the health and safety measures in effect at the time of the Festival. Should the Festival be cancelled, you will be notified as soon as reasonably possible.

VELD:

Three (3) Prizes consisting of one (1) $50 Ticketmaster® gift card (“Gift Card”) each. Gift Card may be used toward the purchase of tickets sold through the Ticketmaster and Live Nation websites and in the Ticketmaster mobile app in the U.S. and Canada. Gift Card cannot be used toward VIP Nation®, fan clubs, other gift cards and select ticket packages. Exclusions may apply to TM+, Platinum, Fan-to-Fan Resale, Ticket Exchange by Ticketmaster® and other tickets not sold directly by Ticketmaster. Other exclusions may apply. Gift Card cannot be combined with other Gift Cards, gift certificates or other coupons. Gift Card may not be used in connection with any marketing, advertising or promotional activities without Live Nation’s prior written approval and may not be transferred or sold other than through authorized Ticketmaster channels. Live Nation reserves the right to cancel a Gift Card if it believes that the Gift Card was obtained through fraudulent or unauthorized means. If the Gift Card holder’s purchase exceeds the amount of that Gift Card’s balance, the Gift Card holder must pay the difference by another means. Unused Gift Card balances are not transferable. Gift Card is not returnable or redeemable for cash except in states where it is required by law. Use of Gift Card constitutes acceptance of these terms and the additional terms found here, which are subject to change at any time without notice. The use of a Gift Card on the Ticketmaster and Live Nation websites are subject to the Terms of Use and Privacy Policy on each site.

PRIZE REDEMPTION PROCESS

10.    After revealing the prizing Tier on the Scratch Card, an Eligible Participant must collect the corresponding Prize from the prizing booth located in the activation space on site from an OLG Representative during the Promotion Period.

THIRD PARTY TERMS

11.    Prize Recipients understand and acknowledge that each component of the Prize and the use thereof may be subject to a separate set of third-party terms and conditions, including but not limited to rules, regulations, restrictions, terms and conditions indicated on any tickets associated with the Prizes, in force at the venue hosting each event, and any health and safety polices or protocols associated with any of the foregoing (e.g., COVID-19 testing requirements, vaccination requirements and proof, social distancing requirements, requirements for face coverings, etc.) (“Third Party Terms”). Prize Recipients are responsible for determining the Third-Party Terms applicable to the Prize (or components thereof) and their use thereof and hereby agrees to comply with such applicable Third Party Terms. OLG does not make and expressly disclaims any representations or warranties with respect to any Prize component and expressly disclaims any responsibility or liability to a Winner for any Prize component. The Prize Recipient is solely responsible for complying with Third Party Prize Terms; failure to do so may result in forfeiture of any Prize.

GENERAL RULES:

12.    OLG reserves the right, in its sole discretion, at any time, and without prior notice, to adjust any of the dates, timeframes, location and/or other Promotion mechanics stipulated in these Rules, to the extent deemed necessary by OLG, for purposes of verifying compliance by any participant and/or other information with these Rules, or as a result of any problems, for customer service reasons, or in light of any other circumstances which, in the opinion of OLG, in its sole discretion, affect the proper administration of the Promotion as contemplated in these Rules, or for any other reason.

13.    Eligible Participants hereby agree to release, indemnify and hold harmless forever the Released Parties (as defined herein), from and against any and all claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) which arise from or are in any way related to:

(a) the Eligible Participant’s participation in this Promotion;

(b) any breach by the Eligible Participant of any covenants, agreements, terms, obligations, representations or warranties set forth herein; and 

(c) the acceptance, receipt, possession, use, misuse or non-use of the Prize or any component thereof by the Prize Recipient.

14.    OLG, COC, CPC, Live Nation Canada, Inc. (“Live Nation”); Veld Music Festival Inc. and Veld Music Festival Holdings Inc. (collectively “Veld Festival”); Ticketmaster Canada Ltd, Ticketmaster, LLC (collectively “Ticketmaster”), OLG’s advertising, promotion and Promotion management agencies, each of their respective parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any entity involved in the development, production, administration, or fulfillment of the Promotion, and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) make no representations nor offer any warranty, express or implied, as to the quality or fitness of any of the Prizes awarded in connection with the Promotion. To the fullest extent permitted by applicable law, each Winner understands and acknowledges that they may not seek reimbursement or pursue any legal or equitable remedy from neither OLG nor any of the Released Parties should their Prize fail to be fit for its purpose or is in any way unsatisfactory. For greater certainty and the avoidance of any doubt, by accepting a Prize, each Winner agrees to waive all recourse against the Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part.

15.    OLG reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to OLG – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Promotion; (ii) for the purposes of verifying the eligibility and/or legitimacy of any information for the purposes of this Promotion; and/or (iii) for any other reason OLG deems necessary, in its sole discretion, for the purposes of administering this Promotion in accordance with OLG’s interpretation of the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of OLG within the timeline specified by OLG may result in disqualification in the sole of OLG.

16.    Any personal information provided to OLG, including but not limited to participants’ contact information, is collected pursuant to the Ontario Lottery and Gaming Corporation Act, 1999 and is intended to conduct and administer the Promotion by OLG. 17.    By participating in this Promotion, each Eligible Participant hereby: (i) confirms compliance with these Rules; and (ii) releases the Released Parties from any and all liability in connection with this Promotion and their participation therein.

18.    This Promotion is subject to all applicable laws. The decisions of OLG with respect to all aspects of this Promotion are final and binding, without review or right of appeal. Anyone deemed by OLG to be in violation of OLG’s interpretation of the letter and spirit of these rules for any reason is subject to disqualification in the sole discretion of OLG at any time.

19.    OLG reserves the right to deny an Eligible Participant or reject an Eligible Participant once accepted, for any reason which, in its sole judgment and discretion, it deems proper.

20.    The Released Parties are not responsible for commencing, continuing, or completing the Promotion, or awarding any Prize in the event of circumstances beyond OLG’s control, and OLG may, at its sole discretion, change or alter this Promotion (and/or amend these Rules), as OLG deems necessary in its sole discretion. Without limiting the generality of the foregoing, OLG, in its sole discretion, reserves the right to amend the timing of any other element of this Promotion to satisfy any customer service or promotional integrity issues resulting from uncontrollable circumstances, and this includes the right to similarly extend the time period(s) available to participants to participate in the Promotion. 

21.    OLG reserves the right, in its sole discretion, to withdraw, amend or suspend this Promotion (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of OLG that interferes or may interfere with the proper conduct of this Promotion as contemplated by these Rules, including, without limitation, any error, problem, computer virus, tampering, unauthorized intervention, fraud or failure of any kind whatsoever. Any attempt to undermine the legitimate operation of this Promotion in any way (as determined by OLG in its sole discretion) is a violation of criminal and civil laws and should such an attempt be made, OLG reserves the right to pursue and/or seek sanctions, remedies and damages to the fullest extent permitted by law. 

22.    OLG reserves the right to change or alter this Promotion, as it deems appropriate, including, but not limited to, making changes or alterations to these Rules relating to the accommodation of participants in accordance with the Accessibility for Ontarians with Disabilities Act, 2005.

23.    These rules govern this Promotion and must be followed by all participants at all times. By agreeing to participate in the Promotion, all participants agree to comply with, and be legally bound by, these Rules.

24.    In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Promotion-related materials or any statements by agents of OLG; these Rules shall prevail, govern and control to the fullest extent permitted by law.

25.    All references to times and dates reflect Eastern Time.

26.    This Promotion is subject to the Laws of the Province of Ontario and the Federal Laws of Canada, as applicable.

27.    The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the Rules as if the invalid or illegal provision were not contained herein.

28.    It is expressly understood and agreed by all Eligible Participants that OLG and any Promotion Administrator do not accept responsibility, in whole or in part, for loss, damage or injury, howsoever caused in connection with the Prize or the conduct of this Promotion.

Live Nation, Veld Festival and Ticketmaster are not sponsors of the Contest, and are in no way responsible for the administration of the Contest, the verification of winners or the fulfillment of prizing. All inquiries regarding the Contest should be directed to OLG.
