$5 INSTANT PLINKO Event Game Conditions

RULES AND REGULATIONS

  1. The "PLINKO Event" (the "Final Event") is governed by the Rules Respecting Lottery Games (the "General Rules") of the Ontario Lottery and Gaming Corporation (the "Corporation") which are available upon request and contain additional rules and regulations that apply to the Final Event and limitations of liability.

  2. These Game Conditions for the Final Event (these "Rules") govern the conduct of the Final Event(s) related to all $5 INSTANT PLINKO game(s) that are conducted and managed by the Corporation. Unless otherwise stated, these Rules operate as separate and distinct from any Game Conditions contained on any $5 INSTANT PLINKO tickets and vice versa.

  3. Words used in these Rules which are used in the General Rules shall have the same meaning as those used in the General Rules. In the event of any conflict or inconsistency between these Rules and the General Rules, the General Rules shall govern.

  4. The Final Event and the associated $5 INSTANT PLINKO tickets are available in Ontario, Canada.

ELIGIBILITY TO PARTICIPATE

  1. For a player, individually or as a member of a Group, to be eligible to participate in the Final Event and receive all or part of a Prize, a player must:

    1. meet all applicable eligibility requirements as contained in the General Rules;
    2. be the rightful bearer of a winning $5 INSTANT PLINKO ticket that qualifies such bearer to participate in the Final Event pursuant to the Game Conditions contained thereon;

    3. prior to participating in the Final Event, have participated in any investigation conducted by the Corporation and satisfied the Corporation that they are the rightful bearer of the $5 INSTANT PLINKO ticket and are entitled, and will remain entitled, to any Prize;

    4. have acknowledged the $5 INSTANT PLINKO ticket top prize claim and Final Event will take place over separate days;

    5. have agreed to and signed OLG's Waiver of Liability and Release as required and applicable;

    6. have initiated the prize claim prior to the expiry of the relevant $5 INSTANT PLINKO ticket referenced in Rule 5(b); and

    7. have otherwise complied with the General Rules in all respects.

FINAL EVENT PARTICIPATION

  1. A player may participate in the Final Event through one (1) of two (2) methods: a) the Chip Drop or b) the Prize Draw.

  2. Chip Drop Method

    1. As described in this Rule 7, a player will be provided three (3) chances to complete a single valid PLINKO Chip Drop. After the player has completed a valid Chip Drop, the player will not be provided any more chances. Any Chip Drop that is not valid is deemed to be void and shall not result in any entitlement to a Prize.

    2. A Chip Drop is valid, as determined solely by the Corporation, when the PLINKO chip is released by the player with its face against the PLINKO board and travels unassisted and without stopping to a prize amount slot at the bottom of the PLINKO board.  From the top of the PLINKO board, the player may release the PLINKO chip at the board's entry slot of their choice but must release the chip above the board's plexi-glass cover. The player's hand may not reach under the plexi-glass cover at the top of the PLINKO board and the PLINKO chip may not be touched again by the player once it is released. If the PLINKO chip gets stuck on the PLINKO board before it reaches its final resting spot in a prize slot as per Rule 7(c), this Chip Drop attempt will be considered void. The chip will be retrieved from the PLINKO Board by the Corporation's staff. This will count as one of the player's three (3) chances for a valid Chip Drop.

    3. The Prize to which the player is entitled shall be determined by the final resting prize slot of the PLINKO chip at the end of the first valid Chip Drop in accordance with Rule 15. The PLINKO chip is deemed to have reached the final resting prize slot when it comes to a complete stop in the prize slot and the Corporation declares the Chip Drop complete and valid. If for any reason the PLINKO chip moves after the Corporation has declared the Chip Drop complete and valid, the position of the PLINKO chip at the time the Corporation declared the Chip Drop to be complete and valid shall be deemed as the final resting prize slot of the PLINKO chip.

    4. In the event a player does not complete a valid Chip Drop after three (3) attempts, the Corporation shall use the Prize Draw to determine the player's Prize in accordance with Rule 8 and Rule 16.

    5. The PLINKO chip used in the Chip Drop belongs solely to the Corporation and is not part of the Final Event prize. 

  3. Prize Draw Method

    1. If a player or Group elects to not participate through the Chip Drop, or a player is unable to successfully complete the Chip Drop in accordance with Rule 7, the Corporation will conduct one (1) Prize Draw to determine the player's or Group's entitlement to a Prize.

    2. The Corporation will conduct one (1) Prize Draw to draw a number between one (1) to nine (9) that entitles the player to the corresponding Prize for such number in accordance with Rule 16.

    3. The result of the Prize Draw will be final and binding on the player or Group who shall have no right to any other Prize resulting from the Final Event.

  4. Proxy

    Subject to the Corporation's approval, a player or Group may make a written election to have another individual participate in the Chip Drop on their behalf (a "Proxy"). A Proxy:

    1. shall have no entitlement to any Prize and may be required to execute a release indicating the same prior to participation;

    2. will participate in a Chip Drop in the place of the designator(s), and the result of the Chip Drop shall be final and binding on the designator(s); and

    3. must not be a Related Party and must otherwise meet the eligibility requirements applicable to a player as contained in the General Rules.

    The Proxy may not exercise the election to participate through the Prize Draw, and such election may only be made by the designator. For greater certainty and without limiting this Rule 9, a Proxy must be 18 years of age or older and must not be an employee of the Corporation.

  5. The Final Event will take place at a date and time designated by the Corporation. In order for the player to participate through the Chip Drop, the player or Proxy must attend the OLG Prize Centre located at 20 Dundas Street West, Toronto, Ontario (the "Prize Centre") or a location otherwise specified by the Corporation.

  6. The Chip Drop or Prize Draw will be video recorded for audit purposes, at OLG's sole discretion. The Chip Drop may also be recorded for live broadcast and used for additional marketing and advertising purposes as prescribed in Corporation's Audio/Visual/Photographic Consent Form.

  7. Where a player or Group is unable or unwilling to designate a Proxy, and/or unable or unwilling to attend the Prize Centre or other location required to participate in the Chip Drop in accordance with Rule 10, the Corporation shall use the Prize Draw to determine their entitlement to a Prize. The results of such Prize Draw shall be final and binding on the player or Group.

GROUP PLAY

  1. If a $5 INSTANT PLINKO ticket that meets the requirement contained in Rule 5(b) was purchased by or issued to more than one individual (a “Group”), the members of the Group shall either:

    1. select a single representative to participate in the Chip Drop (a “Designate”). Once selected, the Designate may not be changed without approval by the Corporation; or

    2. elect to have the final Prize determined by Prize Draw.

    Each member of the Group is deemed to represent and warrant to the Corporation that there are no additional members of the Group that may make a claim to entitlement to a Prize and all members of the Group must, prior to participating in the Final Event, execute a release confirming the selection of a Designate and/or their election of the Chip Drop or Prize Draw and that the result of such Designate's Chip Drop or Prize Draw shall be final and binding on all members of the Group.

PRIZE STRUCTURE AND ODDS OF WINNING

  1. The following prizes are available to be won through the Chip Drop or Prize Draw and the overall odds of winning each prize are as follows (each a "Prize" and collectively "Prizes"):

  2. For the Chip Drop, the precise odds for each prize outcome depend on which starting slot a participant selects for the chip drop.

  1. For the Prize Draw, the Corporation shall draw a number from one (1) to nine (9), each number corresponding to a specific Prize. For the purpose of determining entitlement to Prizes using the Prize Draw method, the denominations displayed on the prize slots of the PLINKO board shall correspond to the numbers available in the draw as follows:

MISCELLANEOUS

  1. If for any reason the Corporation determines that the Prize Draw mechanism or the PLINKO board has malfunctioned or is likely to malfunction due to a technical or mechanical failure, ambiguous result, or otherwise, the Corporation may either: (i) declare any Chip Drop or Prize Draw void and will require the player or Proxy to participate in the Final Event through the other method in accordance with Rule 6; or (ii) postpone the completion of a Prize Draw or Chip Drop until such time as it determines that the Prize Draw mechanism or PLINKO board has been restored to proper functioning order. Any decision made by the Corporation pursuant to this Rule shall be final and binding and without any right of appeal.

  2. The Corporation may amend these Rules at any time and in any manner.

  3. The headings in these Rules are for convenience of reference only and do not affect the interpretation of these Rules.

  4. Wherever these Rules allow a Player or Group to make an election with respect to the method of participation, and no such election is made by the date the relevant $5 INSTANT PLINKO ticket expires as noted thereon, or if no extension is requested by the player or Group and granted by the Corporation, the player or Group shall be deemed to have irrevocably elected the lowest Prize denomination as outlined in Rule 14.

  5. All monetary denominations are in Canadian dollars (CAD).

  6. The terms “Proxy”, “player”, “Group”, and “Designate” are interchangeable as context requires.

  7. If any section of these Rules is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be deemed to be stricken and the remainder of these Rules shall continue in full force and effect as far as is practicably possible.

  8. Unless otherwise specified by the Corporation, these Rules govern all Final Events arising from any $5 INSTANT PLINKO tickets issued by the Corporation and are effective as of January 9, 2025.
