Rules Respecting iGaming Lottery Group Play
These Rules Respecting iGaming Lottery Group Play (the “Rules”) apply, until amended or revised, to iGaming Lottery Group Play made available by the Ontario Lottery and Gaming Corporation (“OLG” or the “Corporation”) on OLG.ca. iGaming Lottery Group Play allows Players to purchase Tickets for certain Draw-Based Lottery Games Played Online as part of a group and share in any prizes won by the group, as further set out herein. The Rules do not apply to group play of Lottery Games made available at retailer locations. It is a condition of participating in iGaming Lottery Group Play that you agree to be bound by these Rules, the Ontario Lottery and Gaming Corporation Rules Respecting iGaming Lottery Games (“iLottery Rules”), the relevant Game Conditions, instructions governing the specific Draw Based Game Played Online that you choose to play and the Player Agreement and, if you choose to play an ILC Game, the ILC Rules.
Any capitalized terms not otherwise defined herein shall have the meaning ascribed to them in the iLottery Rules. Words used in these Rules that are used in the Game Conditions for the specific Lottery Game and in the Regulations have the same meaning as those used in the Regulations. Words in the singular shall include the plural, and words in the masculine gender shall include the feminine.
1. INTERPRETATION
- 1.1 In these Rules:
- "CASL” means An Act to promote the efficiency and adaptability of the Canadian economy by regulating certain activities that discourage reliance on electronic means of carrying out commercial activities, and to amend the Canadian Radio-television and Telecommunications Commission Act, the Competition Act, the Personal Information Protection and Electronic Documents Act and the Telecommunications Act, and the regulations made thereunder, as amended from time to time.
- “Draw Based Games Played Online” has the meaning set out in the Player Agreement.
- “Group” means:
- a Group Play group created by a Player as Group Captain, which consists of the Group Captain and can include other Group Members up to the Group Size Limit; or
- a Group Play group created by OLG as Group Captain, which consists of the Group Captain and can include Group Members up to the Group Size Limit.
- “Group Captain” means OLG or a Player who creates and/or manages the Group, as further set out in the Rules.
- “Group Member” means an eligible individual who is either: (i) a Player that is a Group Captain; or (ii) after receiving and accepting an invitation to join the Group by the Group Captain, a Player approved by the Group Captain as a member of a Group.
- “Group Name” means the name of a Group as set out by the Group Captain.
- “Group Pack” means the configuration of plays for ongoing Draws that a Group Member must purchase as a Ticket to participate in a Group Play. Each Group Pack consists of the number of plays for a Host Product, plus an optional number of ENCORE plays where applicable.
- "Group Prize” means the total aggregate prize (including cash and/or free play lottery ticket(s)) from all Winning Tickets purchased as part of a Group Pack, available to Participating Members.
- “Group Size Limit” means the number of Group Members configured for a given Group, up to a maximum number specified by OLG which may be revised from time to time. Where OLG is a Group Captain, it will be included in the tally with Group Members for Group Size Limit purposes.
- “Host Product” means the eligible Draw-Based Game Played Online for which a Group Pack is formed.
- “iGaming Lottery Group Play” or “Group Play” means the functionality on OLG.ca facilitating the play of eligible Draw Based Games Played Online by way of a group, wherein Players participate by purchasing Tickets as part of a Group Pack and share in any group winnings as further set out herein.
- “Invite” has the meaning set out in Section 6.4(a).
- “Participating Member” means a Group Member who has purchased a Ticket as part of a Group Pack. For greater certainty, where OLG is the Group Captain of a Group, the Group Captain is not a Participating Member.
- "Player” has the meaning ascribed to the term “player” in the iLottery Rules.
- “Prize Share” or “Share” is the prize to which a Participating Member is entitled as a result of a Winning Ticket purchased as part of a given Group Pack as further set out in Section 4.3.
- “Promotions” has the meaning set out in Section 6.7.
- 1.2 In the event of a conflict between any of the following documents, the conflict shall be resolved in descending order of the following clauses, with the lower numbered clauses taking precedence over higher numbered clauses:
- the Regulations;
- the Rules;
- the ILC Rules (if applicable);
- the iLottery Rules;
- the applicable Game Conditions;
- the instructions, if any;
- the Player Agreement; and
- the Ticket
2. Eligibility and Scope:
- 2.1 Any Player with a valid Player Account in good standing in accordance with the Player Agreement is eligible to participate in Group Play.
- 2.2 The Corporation may at any time add, remove or modify Draw-Based Games Played Online that are eligible for Group Play at its sole discretion.
3. How to Play
- 3.1 Players may elect to participate in Group Play as a Group Captain or Group Member.
- 3.2 A Player may be designated as Group Captain for more than one Group. A Group Captain that is a Player cannot be designated as Group Captain for two or more Groups with the same Group Name.
- 3.3 A Group will be established when:
- the Group Name and Group Size Limit has been set by the Group Captain; and
- at least one Group Pack has been created by the Group Captain.
- 3.4 Group Names must not be hateful, discriminatory, sexist, violent, offensive or otherwise inappropriate, as determined by the Corporation in its sole discretion. The Corporation may take all steps that it determines is appropriate in the circumstances with respect to any Group Name that it deems to be non-compliant with the Rules, including, but not limited to, requiring that the Group Name be changed or deactivating the Group.
- 3.5 A Group Captain may change the Group Name at any time.
- 3.6 A Group Captain may change the Group Size Limit at any time. The Group Size Limit cannot exceed the maximum set by OLG.
- 3.7 To participate in Group Play as a Participating Member, a Group Member must purchase a Ticket (individually or as part of a Lottery Subscription) as part of a Group Pack.
4. Wins and Prize Claims
- 4.1 Each Ticket purchased by a Participating Member in a Group Pack is jointly owned by all Participating Members. All Participating Members will be entitled to claim their respective Prize Share in association with any and all Winning Ticket(s) purchased or won as part of a Group Pack.
- 4.2 Only Participating Members are eligible for any Prize won as part of a Group Pack. For clarity, a Group Member must have purchased at least one Ticket in a Group Pack to be eligible to win any prize associated with the Group Pack.
- 4.3 A Group Prize will be divided equally by the number of Participating Members of a Group Play. To the extent any Group Prize cannot be divided exactly equally amongst Participating Members, OLG will distribute any residual amounts to Participating Members in the order in which each Participating Member purchased a Ticket as part of the relevant Group Pack, as determined solely by OLG .
- 4.4 To the extent any Winning Ticket associated with a Group Pack includes a Free Play lottery ticket, that Free Play lottery ticket will be jointly owned by the Participating Members and any prize associated with the redemption of said Free Play lottery ticket will be shared equally amongst the Participating Members.
5. Cancellations
- 5.1 A Group Member may at any time be removed from a Group at the election of the Group Member or the Group Captain or at the sole discretion of the Corporation. If a Group Member is removed from a Group, they will not lose entitlement to their Prize Share on that basis if they were a Participating Member prior to their removal from the Group.
- 5.2 A Group Captain may at any time elect to remove a Group Pack from a Group, after which time it is no longer available for Group Play Ticket purchases. If a Group Pack is removed from a Group, Group Members who became Participating Members of such Group Pack before it was removed will not lose entitlement to their Prize Share on that basis.
- 5.3 If a Group Captain that is a Player elects to leave a Group, the next earliest Group Member to have joined the Group will automatically become Group Captain of the Group.
6. Other Terms
- 6.1 The Player acknowledges that, as a Group Member, their first name, and the first letter of their last name associated with their Player Account may be visible to all other Group Members in the same Group.
- 6.2 The number of Group Members in a Group is subject to change without notice to Group Members of the Group.
- 6.3 Group Captains and Group Members and their respective participation in Group Play, including the sending of any invitation to an individual to participate in Group Play, shall comply with CASL at all times.
- 6.4 Group Members shall not:
- Request or receive payment for the provision of any invitation link that when acted upon requests to join a Group as a Group Member (“Invite”);
- Make any Invite available to the general public, including, but not limited to, by publicly posting or otherwise communicating the link on any website or social media platform;
- Use, display, or manipulate OLG intellectual property (including, but not limited to, OLG logos, trademarks, and copyright-protected works) in any manner contrary to the Player Agreement, save and except the use of the “OLG” wordmark to identify themselves as a Player and/or Group Captain;
- Use automated systems or bots through any channel to distribute, post, or otherwise share an Invite;
- Transmit any content as part of an Invite that is threatening, hateful, discriminatory, sexist, violent, offensive or otherwise inappropriate or that contains a malicious code, virus, Trojan horse, worm, logic bomb, drop-dead device, backdoor, shutdown mechanism or similar software that is intended or likely to disable, harm, affect or interfere with the normal use of any individual’s hardware, software or systems used to view or access the Invite; and
- Suggest the existence of an affiliation, sponsorship or similar relationship with OLG or make any misleading statements about their relationship with OLG.
- 6.5 The number of Participating Members in a Group Pack is subject to change at any time prior to the Close of Play without notice to Participating Members of the Group Pack. Group Members acknowledge that their Prize Share, if won from a Group Pack, will depend on the final number of Participating Members in the Group Pack at the Close of Play. Group Members are solely responsible for verifying the final number of Participating Members in a Group Pack. OLG will not in any way be responsible or liable for a Group Member’s failure to review the final number of Participating Members in any Group Pack.
- 6.6 The Corporation may deactivate a Group at any time in its sole discretion. Upon the deactivation of a Group: (i) any scheduled Ticket purchase as part of a Group Play that has not been completed prior to the Group deactivation will be cancelled; (ii) Players who become Participating Members prior to the deactivation of a Group will not lose entitlement to their Prize Shares on that basis, if applicable; and (iii) Players will not be entitled to purchase a Ticket as part of a Group Play for the deactivated Group.
- 6.7 OLG and/or its partners may, from time to time, engage in contests and promotions related to Host Products that result in a Participating Member being eligible to win certain prizing or other opportunities, including but not limited to free play lottery tickets (“Promotions”). To the extent that any purchase of a Ticket by a Participating Member as part of any Group Pack results in the ability of that Participating Member to enter or take advantage of a Promotion, any benefit or prize associated with that Promotion is solely the Participating Member’s and shall not be considered part of Group Play or any Group Prize. For clarity, Promotions do not include any additional prize draws that may be made available from time to time by OLG or ILC as part of the lottery scheme associated with any Ticket that is purchased in a Group Pack. By way of example only, LOTTO 6/49 Super Draw prizes, if available to be won on any Ticket purchased in a Group Pack, would be considered a part of the Group Prize. OLG will be the sole determinant of whether or not a certain prize or benefit associated with any Host Product falls within the scope of the Promotion definition in this Section 6.7.
7. General
- 7.1 The Corporation may amend the Rules at any time and in any manner.
- 7.2 In the event any provision of the Rules or of the conditions and explanations appearing on a ticket or of such other conditions as are established by the Corporation are determined by a court of competent jurisdiction to be void or unenforceable, such determination shall solely affect such provision and shall not, in itself, render void or unenforceable the remaining provisions thereof.
- 7.3 The Rules shall be governed by, subject to and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada as applicable therein. The courts of the Province of Ontario shall have exclusive jurisdiction to entertain any action or other legal proceedings based on or arising out of the Rules or any lottery game.
- 7.4 The headings in the Rules are for convenience of reference only and do not affect the interpretation of the Rules.
- 7.5 Unless otherwise specified by the Corporation, the Rules are effective as of May 10, 2024.
